Brazil: New registration requirements for non-resident investors

Clearstream Banking1 customers are required to use the new investor form template in order to request the opening of a passenger account, for investment in Brazil.

This new template adds new categories of investors, such as Trusts or other fiduciary vehicles and companies incorporated with bearer securities.

Background

The Brazilian Securities and Exchange Commission (Comissáo de Valores Mobiliários – CVM) released on 30 March 2015 instruction 560 (replacing instruction 325), related to registration, permitted transactions and the disclosure of information of non-resident investors in Brazil. The instruction was updated in accordance with the CMN (Conselho Monetário Nacional) Resolution 4.373 issued in September 2014, substituting the CMN Resolution 2.689.
