Further to our Taxflash T15034, dated 28 July 2015, the Belgian Government has recently confirmed that the increase of the withholding tax rate (“précompte mobilier”) from 25% to 27% and the taxation of capital gains will take effect on
1 January 2016
Impact on customers
- The new withholding tax rate of 27% will be applied from 1 January 2016. The procedure for obtaining relief at source or refund of tax will remain the same as today. Please refer to the Market taxation guide – Belgium for further details.
- Capital gains tax (CGT) will be applicable to individual investors only, at a rate of 33%. It will be levied for transactions on listed companies and for a holding period of six months or less. Clearstream Banking does not assist in this regard and no CGT will be withheld through Clearstream Banking. Please consult your tax advisor for further information.
