Portugal: Renewal of the Statement for Exemption for ISIN PTPBTMGE0011

For those customers of Clearstream Banking1 who hold ISIN PTPBTMGE0011, a Portuguese debt security, the validity of the Statement for Exemption from Portuguese Withholding Tax on Income from Debt Securities dated 2014 will expire on 31 December 2014.

We remind customers that for the securities issued before 31 December 2013, the Law 83/2013 only applies to income received after the first coupon payment date or redemption per security occurring after the aforementioned date; that is, starting from 2014).

This ISIN PTPBTMGE0011 is a zero-coupon issued on 20 September 2013 and therefore its redemption (which will take place on 20 March 2015) falls under the old regime (Decree-Law 193/2005). In order to comply with the holding restriction established by Paragraph 2 of Article 17 of the Special Tax Regime approved by Decree-Law 193/2005 on 7 November, and to benefit from exemption at source on the interest payment foreseen on 20 March 2015, customers must provide, in addition to the List of Beneficial Owners requested before the event, a new Statement for Exemption from Portuguese Withholding Tax on Income from Debt Securities, dated 2015, no later than

15 January 2015

The statement, among other items, certifies that final beneficial owners of Portuguese debt securities do not fall into any of the following categories:

  • Residents for tax purposes in a country or territory considered as a tax haven by Portuguese legislation, except central banks and government agencies resident in those countries; or
  • Residents of Portugal subject to Portuguese withholding tax and not eligible for exemption at source; or
  • Non-resident institutions more than 20% owned by entities resident in Portugal;

and that they are therefore entitled to exemption from Portuguese withholding tax.
