Russia: Presidential Decree N°95

Further to Announcement A22021, Clearstream Banking¹ informs customers that following the Presidential Decree N°95 issued on 5  March 2022, Central Bank of Russian Federation (CBRF) Prescription No. 018-34-4/1468 dated 6 March 2022 clarifies that the blocking regime put in place by CBRF Prescription No. 018-34-3/1202 dated 28 February 2022 no longer applies to foreign custodians and foreign nominees and consequently only the regime set up by Presidential Decree N°95 should be considered from 1 March 2022.

Clearstream Banking is in discussion with the National Settlement Depository (NSD) to understand and assess the impact of Presidential Decree N°95 for Clearstream Banking and its customers.

Nevertheless, all the restrictions as communicated in Announcement A22018 continue to apply to certain foreign-owned holdings and therefore Bridge, Internal and Domestic settlement remain closed as well as access to the securities held on Clearstream Banking’s Depository 5R. Corporate action proceeds in securities deposited on Depository 5R will not be credited to Clearstream Banking’s account with the NSD. Corporate actions and income proceeds denominated in RUB on securities deposited elsewhere, for example in the Common Depository network will continue to be collected to the extent that applicable sanctions permit and to the extent that proceeds are paid and reported to Clearstream Banking’s depository or CCB account.
