U.S. Ukraine- and Russia-related sanctions update III

Clearstream Banking¹ refers to its previous Announcements (A18061, A18045 and A18043) concerning Ukraine -/Russia-related Designations and Identification and the Issuance of Ukraine- and Russia-related General Licenses 12, 12A, 13 and 14 of the United States Department of the Treasury of 6 April 2018.

Clearstream customers are advised  that all customer settlement instructions need to be in place by 18:00 CET on 4 May 2018 for securities issued by entities covered by OFAC General License 13. No instructions will be accepted if they are made after this deadline, or if they have an intended settlement date after 4 May 2018. Customers are advised that the Bridge between Clearstream Banking S.A. and Euroclear Bank SA/NV will be closed thereafter.

Security codes eligible in Clearstream issued by entities covered by OFAC`s General License 13 are:

Customers are reminded that when instructing the receipt of any of the above securities, including across the Bridge, the following representation must be added into the narrative of their instruction:  “We represent that we have verified the identity of the ultimate recipient of the quantity of securities covered by this instruction and that it is neither a U.S. person nor any person who is, or who is equivalent to, a Specially Designated National by the United States Department of the Treasury.”  

For domestic market settlement, the customer delivering securities to the domestic market must provide the same representation.

On 7 May 2018, all pending customer instructions which remain for the following security codes issued by Specially Designated Nationals will be automatically cancelled:

In respect of future income events, Clearstream intends to apply the provisions of General Licenses 12A and 14 to any expected income payments that arise between now and 22 October 2018.
