Ireland: List of migrating securities and cross-border settlement between CREST and Euroclear Bank - Update

Further to Announcements A20164, A21020 and A21026, Clearstream Banking1 would like to provide customers with the list of migrating securities and instruction specifications for cross-border settlement effective

15 March 2021

between the CREST system of Euroclear UK and Ireland (CREST) and Euroclear Bank.

Customers are reminded that from 15 March 2021 to 26 April 2021 Clearstream Banking continues to hold Irish corporate securities in CREST and the services as described in the Market Link Guide - Ireland - Equities, corporate bonds and other instruments continue to be applicable within this period.

Impact on customers

List of migrating securities

Based on the list communicated by Euronext Dublin, Euroclear UK and Ireland (EUI) has provided a list of Irish corporate securities to be migrated from EUI to Euroclear Bank (see attachment below).

Cross-border settlement

Customers can instruct to receive free of payment in CREST from Euroclear Bank and deliver free of payment from CREST to Euroclear Bank by using the following formats. Customers are reminded that against payment settlement is not possible between CREST and Euroclear Bank.

Irish stamp duty on cross-border transactions

EUI have advised that when an instruction is sent from the CREST system to Euroclear Bank, the stamp exempt indicator is included by default in each instruction as it is assumed by EUI that assessment and collection of Irish stamp duty in relation to the CREST participant will take place in the CREST system. Separately, the associated matching instruction input in Euroclear Bank’s settlement system by the relevant Euroclear Bank account holder will also be subject to the Irish stamp duty rules set out by Euroclear Bank. It is therefore possible for both the CREST member and the Euroclear Bank account holder, in the respective systems, to incur stamp duty charges if the appropriate Irish stamp duty declarations are not specified on the respective instructions. If this does occur, a reclaim may subsequently be made to the Irish Revenue Commissioners.

Customers should pay specific attention to stamp duty values in their cross-border instructions and when there is no change of beneficial owner, use the stamp exemption values as provided in the Market Link Guide - Ireland - Equities, corporate bonds and other instruments.

Deadline for sending cross-border instructions to Clearstream Banking

Customers are recommended to send their free of payment cross-border instructions to Clearstream Banking on SD-1.
