U.S. Ukraine- and Russia-related sanctions update IV: General License 13A of the United States Department of the Treasury

Clearstream Banking¹ refers to its previous Announcements (A18061, A18045, A18043 and A18063) concerning Ukraine -/Russia-related Designations and Identification and the Issuance of Ukraine- and Russia-related General Licenses 12, 12A, 13 and 14 of the United States Department of the Treasury of 6 April 2018.

Customers are advised that settlement instructions will be accepted and processed until 18:00 CET on 5 June 2018 for securities issued by entities covered by OFAC General License 13A. No instructions will be accepted if they are made after this deadline, or if they have an intended settlement date after 5 June 2018. Customers are advised that the Bridge between Clearstream Banking S.A. and Euroclear Bank SA/NV will be closed thereafter.

Security codes eligible in Clearstream issued by entities covered by OFAC`s General License 13 are:

When instructing the receipt of any of the above securities, including across the Bridge, customers must add the following representation into the narrative of their instruction:  “We represent that we have verified the identity of the ultimate recipient of the quantity of securities covered by this instruction and that it is neither a U.S. person nor any person who is, or who is equivalent to, a Specially Designated National by the United States Department of the Treasury.”

For domestic market settlement, the customer delivering securities to the domestic market must either provide the same representation or represent that the instruction relates to an on-exchange transaction.

Customers are further advised that Clearstream Banking will cancel all pending instructions in the below security codes that were issued before 1 May 2018 and which are therefore covered neither by the General License 13 nor by General License 13A of the United States Department of the Treasury. Customers may re-instruct any such instructions for an Intended Settlement Date of 2 May 2018 or later:

Income and Corporate Events

In respect of future income events, Clearstream Banking intends to apply the provisions of General Licenses 12A and 14 to any expected income payments that arise between now and 22 October 2018.
